Rental Property Healthy Homes Fines
Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Wallaceville rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.
Beginning on July 1st, 2021, once a new, renewed or varied lease is entered into on the Wallaceville rental property, all Healthy Homes compliance work must be completed within 90 days.
Inability to adhere to one of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager does not provide the necessary information within 21 days from having received the inquiry, they will receive an infringement notice and could be fined up to $750.
In addition, there is an additional fine of approximately $900 for property owners or property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord as well as the property management company.
The information contained in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed. It is updated throughout the duration of the tenancy when any associated work has been completed.
It’s also crucial to remember that a landlord who manage several rental properties can face greater penalties for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.
