Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Totara Park rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

From the 1st of July in 2021, if a new or renewed lease is entered into on the Totara Park rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the necessary information within 21 days of getting the notice, the tenant will receive an infringement letter and be fined up to $750.

In addition, there’s also a fine of up to $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be correct when the tenancy contract is executed, and it must be updated throughout the tenancy as any necessary work related to it is finished.

It’s also important to remember that landlords who own multiple rental properties could face greater penalties for non-compliance. The most severe penalties are given for severe violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Totara Park Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required throughout Totara Park and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to any Healthy Homes Standard that apply or will be in force to your rental home.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Totara Park

Draughts can lead to dropping temperatures within homes. A draughty house costs more to heat, meaning wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air coming in or a clear draught out of a hole or gap that is, it’s probably a gap or hole which requirements sealing in the way you can. Large gaps and cracks should be permanently stopped. The gaps that exceed 3mm that allow air in or out within the home require to be sealed. For example, if the open fireplace is not in use, it can cause draughts and should be sealed from. Heating Totara Park

Rental properties in Totara Park require a reliable heating source that can heat the largest or main living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements to remain fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and meet the minimum heating capacity needed in the living area. In certain situations, like apartments with small spaces an electric, fixed heater might be enough.

If your living space already has a permanent heating source, like heat pumps, it may need an update in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard because they’re costly, not affordable to run, and/or unhealthy to run.

Ceiling and underfloor insulation is required in all rental houses since July 1, 2019. Property managers and landlords should ensure the insulation meets standards that are in line with the latest quality.
