Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Strathmore Park rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

Beginning on July 1st, 2021, when a new or renewed lease is entered into on a Strathmore Park rental property, all Healthy Homes compliance work must be completed within 90 days.

It’s also crucial to remember that a landlord who own multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved only for serious breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 in hearings.

Strathmore Park Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required in all Strathmore Park and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with the Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

What are unreasonable gaps and holes?

If you can feel external air entering or a clear draught from a crack or a gap and you can feel it, it is probably a gap or hole that needs sealing in the way you can. Large cracks and gaps should be permanently stopped. The gaps that exceed 3mm that let air into or out from the home need seals. In the case of an open fireplace isn’t being used, it may cause draughts and should be sealed from. Heating Strathmore Park

Strathmore Park rental properties require a reliable source of heating that can warm the{ main or largest|| largest or main| principal or the biggest} living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to remain fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity in the living area. A Heating Assessment Tool may be used to check if your current fixed heater(s) are sufficient or whether you will need to "top up" with an additional heater. Open fires as well as unflued combustion heaters like small portable LPG bottle heaters are not considered to be suitable heating options under Healthy Homes Standard. Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), then it must have the thermostat. This makes your heating more consistent and effective. For most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If your living space already has a permanent heating source such as the heat pump, it may require a top up to meet the standards. Certain types of heaters cannot be utilised to meet the standard as they are either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Strathmore Park

Every living space in the rental property should contain at minimum one open doors or windows to offer natural ventilation. In addition, humid areas like kitchens and bathrooms must have a suitable externally vented extractor to remove moisture.

The ventilation standard is about recognising it is that dry air is much easier to heat, and that a property that is well ventilated is less likely to be a victim of damp and mould.
